Slip and Fall
Slip and fall claims are a form of premises liability: property owners have a responsibility to keep their property reasonably safe. The standard varies based on circumstances and jurisdiction.
Common next steps
Step 01
Report it on the spot
Ask the manager, owner, or staff to file an incident report. Get a copy or at least the name of who took the report.
Step 02
Photograph the hazard
Wet floors get dried, ice melts, broken steps get fixed. Photos and video taken in the first few minutes are often impossible to recreate.
Step 03
Keep your shoes
A common defense is that the footwear caused the fall. Bag your shoes and store them.
When people often consult an attorney
- Whether the property owner knew of the hazard
- Whether warnings were posted
- Documentation gaps in medical care
- Disputes about your role in the fall
